Come clean over Sabah’s 40% revenue rights, MCA Youth Sabah tells govt

MCA Youth Sabah has expressed disappointment over what it described as the federal government’s “confusing and self-contradictory” position on Sabah’s 40% revenue entitlement.

Its chairman Roger Yapp said this in reference to the statement by the Attorney General’s Chambers (AGC) on Nov 11 that there would be “no appeal” against the Kota Kinabalu High Court’s ruling but that it would appeal “defects in the grounds of judgment”, still amounted to an appeal.

For context On Oct 17, the Kota Kinabalu High Court ruled in favor of the Sabah Law Society (SLS) judicial review.

The court decided that the Federal Government had acted unlawfully by failing to fulfill Sabah’s constitutional entitlement to 40% of the net federal revenue derived from the state for nearly five decades.

“This is not only contradictory but also beguiling. Such ambiguity appears to be a calculated attempt to create the impression that the government respects the Kota Kinabalu High Court’s decision while still pursuing an appeal behind the scenes,” Yapp said.

“Sabahans deserve clarity, not confusion. If the government is genuine about upholding the High Court’s decision, then it should be transparent about its actions. The current doublespeak only serves to undermine trust and insult the intelligence of Sabah folks.

“The principle is simple: either you are appealing, or you are not. There is no middle ground. A responsible government should not twist its words or hide its true intentions when it comes to Constitutional matters. Integrity demands honesty, not spin.”

According to Yapp, Putrajaya should be reminded that Sabah’s 40% revenue entitlement is not a “political privilege” but a Constitutional right guaranteed under Articles 112C and 112D of the Federal Constitution.

“This was part of the foundation on which Malaysia was formed. Fulfilling this obligation is not an option; it is a duty,” he stressed.

“When the federal government issues mixed messages on an issue of such importance, it only deepens public distrust and damages the credibility of its commitment to fair federal-state relations. Respecting the Constitution also means respecting Sabah’s rightful share.”

Calling for the federal government to immediately clarify whether an appeal has in fact been filed, MCA Youth Sabah said Putrajaya must further openly explain its scope and justification and also respect and honour Sabah’s constitutional entitlement to 40% of its revenue.

“Above all, it must stop confusing the public and begin governing with honesty, integrity, and transparency. Good governance is thrusted on truth and accountability, not on vague statements or political wordplay,” Yapp emphasised.

“Sabahans can see through such inconsistencies, and they will hold leaders accountable for any attempt to obscure the truth. The federal government should no longer wait to demonstrate genuine respect—for the Constitution, for Sabah’s rights, and for citizens’ intelligence.” ‒ Nov 13, 2025
