Pengadu terima panggilan pertama Ebit Lew jam 3.40 pagi

TENOM: Seorang wanita hari ini memberitahu Mahkamah Majistret di sini bahawa dia menerima panggilan telefon pertama daripada Ebit Irawan Ibrahim Lew atau Ebit Lew pada jam 3.40 pagi, 4 Mac 2021.

Wanita berusia 40an itu, selaku saksi kesembilan pendakwaan yang juga pengadu kes berkata demikian semasa pemeriksaan utama oleh Timbalan Pendakwa Raya Zahida Zakaria pada perbicaraan kes gangguan seksual pendakwah tersebut.

Beliau berkata dalam panggilan selama 291 saat itu (4 minit 51 saat), dia dapat mengecam suara pendakwah itu kerana pernah mendengarnya melalui media sosial, ceramah dan sesi siaran langsung yang dikendalikan Ebit Lew.

“Saya ingat masa itu beliau (Ebit Lew) bertanya tentang saya dan keluarga…dia tanya berkenaan pekerjaan, apa masalah yang dihadapi sehingga berminat dengan program beliau dan saya pun masa itu beritahu tentang keluarga saya dan permasalahan saya,“ katanya.

Terdahulu, Zahida dalam pemeriksaan utama bertanyakan kepada saksi dengan merujuk dokumen daripada syarikat telekomunikasi Celcom iaitu maklumat pelanggan dan butiran panggilan sekiranya ada panggilan dibuat daripada nombor telefon Ebit Lew kepada saksi.

Saksi berkata sebelum itu, pada tarikh sama pada jam 2.28 pagi, Ebit Lew buat pertama kali menghantar mesej kepadanya di aplikasi Whatsapp selepas wanita itu memberikan nombor telefonnya di Instagram milik tertuduh pada 3 Mac 2021.

Beliau berkata sejak itu sehingga 29 Mac 2021, Ebit Lew sering menghantar mesej di Whatsapp selain membuat panggilan telefon kepadanya dan semakin berani menulis perkara berkaitan seksual.

Saksi berkata jam 11.35 pagi pada 22 Mac 2021, Ebit Lew yang memberitahu sedang transit di Dubai mahu melakukan panggilan video kepadanya namun wanita itu bertindak mematikannya.

“Dia terus buat panggilan video call, saya terus off. Dalam teks (Whatsapp) itu dia tanya kenapa off (telefon), ‘tak aci’. Seingat saya masa itulah dia (Ebit Lew) buat panggilan video call dalam keadaan tidak berbaju,“ katanya.

Pada prosiding hari ini, pendakwaan juga mengemukakan kepada mahkamah Digital Forensic Case Report oleh Cyber Security Malaysia yang mengandungi mesej perbualan antara saksi dan Ebit Lew.

Ebit Lew, 38, berdepan 11 pertuduhan antaranya mengaibkan kehormatan seorang wanita berumur 40-an dengan menghantar perkataan dan gambar lucah ke nombor telefon mangsa melalui aplikasi WhatsApp antara Mac dan Jun 2021.

Pendakwah itu didakwa mengikut Seksyen 509 Kanun Keseksaan yang membawa hukuman maksimum penjara lima tahun atau denda atau kedua-duanya, jika sabit kesalahan.
