KUALA LUMPUR: Peguam Tan Sri Muhammad Shafee Abdullah meminta pihak pendakwaan di dalam perbicaraan kes 1Malaysia Development Bhd (1MDB) melibatkan Datuk Seri Najib Abdul Razak supaya mengekalkan atau menarik balik tiga pertuduhan melibatkan penyalahgunaan kuasa dan pengubahan wang haram, daripada memindanya.
Peguambela veteran itu berhujah demikian ketika membantah permohonan pendakwaan untuk meminda tiga daripada 25 pertuduhan dihadapi anak guamnya.
Semalam, Timbalan Pendakwa Raya (TPR), Kamal Baharin Omar memberitahu Mahkamah Tinggi di sini bahawa mereka memohon meminda satu daripada empat pertuduhan penyalahgunaan kuasa Najib dan dua daripada 21 pertuduhan pengubahan wang haram berikutan testimoni dua saksi iaitu Penganalisis Bank Negara Malaysia Adam Ariff Mohd Roslan dan Penolong Pengarah Bahagian Siasatan Jenayah Pengubahan Wang Haram ACP Foo Wei Min.
Mengenai pertuduhan salah guna kuasa, pendakwaan mahu meminda jumlah daripada RM49.9 juta kepada RM44.6 juta, sementara pendakwaan mahu meminda pertuduhan ke-10 yang Najib melakukan pemindahan wang bagi pertuduhan pengubahan wang haram melibatkan RM652.6 juta kepada RM515.7 million.
Selain daripada itu, pendakwaan juga mahu meminda pertuduhan ke-21 melibatkan pemindahan dana dengan mengurangkan jumlahnya daripada RM12.4 juta kepada RM11.4 juta.
Hari ini, Muhammad Shafee berhujah bahawa permohonan berkenaan di buat pada peringkat akhir perbicaraan, maka ia adalah tidak adil kepada tertuduh dan pendakwaan tidak seharusnya mengubah peraturan mereka.
“Mereka sama ada boleh mengekalkan atau menarik balik ketiga-tiga pertuduhan itu. Kami menggesa mahkamah ini tidak membenarkan pindaan itu. Pertuduhan itu adalah asas kepada perbicaraan ini. Anak guam saya didakwa pada 2018 dan pendakwaan mahu meminda ketiga-tiga pertuduhan itu selepas lima tahun.
Keadilan tidak hanya datang daripada mahkamah. Keadilan perlu juga datang daripada pendakwaan yang merangka pertuduhan untuk kepentingan keadilan dan seharusnya mengemukakan pertuduhan yang betul selepas siasatan yang menyeluruh. Pendakwaan sepatutnya melakukannya dengan adil dan tidak menyusahkan tertuduh dengan ketidakadilan,” katanya.
Pada ketika itu, TPR Ahmad Akram Gharib bangun dan berkata pindaan itu dibuat sebenarnya untuk mengurangkan jumlah wang yang terlibat, maka ia akan memberi manfaat kepada Najib bukannya prejudis.
Najib, 70, berdepan empat pertuduhan menggunakan kedudukan beliau untuk memperoleh suapan berjumlah RM2.3 bilion dana 1MDB dan 21 pertuduhan pengubahan wang haram membabitkan jumlah yang sama.
